3. Permitted Uses

3.1 Personal Use

4.2 Filing a DMCA Takedown Notice

If you believe your copyrighted work has been infringed on our Services, submit a written notification containing all required elements (17 U.S.C. § 512(c)(3)):

  • Signature: Physical or electronic signature of the copyright owner or authorized agent
  • Identification of copyrighted work: Title, description, copyright registration number (if registered), URL or location of authorized work
  • Identification of infringing material: Specific URL(s) where material appears, or description if URL is not available
  • Contact information: Full legal name, mailing address, telephone number, email address
  • Good faith statement: Statement that you have a good faith belief that use of the material is not authorized
  • Accuracy statement: Statement under penalty of perjury that the information is accurate and you are the copyright owner or authorized agent

Incomplete notices will not be processed.

4.3 Response to Valid DMCA Notices

Upon receiving a valid DMCA notice, we will:

  • Promptly remove or disable access to the allegedly infringing material
  • Notify the user who posted the material
  • Document the notification and our response
  • Terminate repeat infringers accounts per our repeat infringer policy

Timeline: We typically respond within 48-72 hours of receiving a complete notice.

4.4 DMCA Counter-Notification

If you believe material was removed in error, you may file a counter-notification containing the required elements (17 U.S.C. § 512(g)(3)):

  • Your physical or electronic signature
  • Identification of the material removed and its location before removal
  • Statement under penalty of perjury that you have a good faith belief that material was removed by mistake or misidentification
  • Statement consenting to jurisdiction of Federal District Court for your location (or District of Colorado if outside U.S.)
  • Your name, address, and telephone number

4.5 Repeat Infringer Policy

We maintain a policy of terminating accounts of users who repeatedly infringe copyrights:

  • Three verified infringement notices result in account review
  • Account termination after substantiated pattern of infringement
  • Terminated users may not create new accounts
  • Appeals may be submitted to legal@money-smarts.com

4.6 Misrepresentation Consequences

False or bad faith DMCA notices or counter-notifications may result in:

  • Liability for damages under 17 U.S.C. § 512(f)
  • Attorney's fees and costs
  • Account termination
